These Terms and Conditions (“Terms”) govern your access to and use of Lernwerd at https://www.lernwerd.com (the “Service”). By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

Lernwerd is a free web application that provides an English dictionary experience and spaced-repetition vocabulary learning features. The Service is delivered primarily as a static client-side application. Ads may appear through Google AdSense to help support the Service.

How we handle information is described in our Privacy Policy, which is incorporated by reference into these Terms.

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that you can form a binding agreement under the laws that apply to you.

You may use the Service for personal, non-commercial vocabulary learning and dictionary lookup, subject to these Terms.

You agree not to:

• Use the Service in any unlawful way or for any unlawful purpose
• Interfere with or disrupt the Service, its hosting, or other users’ access
• Attempt to scrape, harvest, or systematically download the dictionary corpus at a scale that harms the Service or violates third-party data licenses
• Circumvent security or access controls, or misuse automated access in a way that degrades the Service
• Misrepresent your identity or affiliation in connection with the Service

You do not need an account to use most of the Service. Learning progress and notes can stay on your device.

If you use Sync, you sign in with Google OAuth so your learning data can be saved to Google Drive and restored on another device. Sync is optional.

Personal notes and learning data you create belong to you.

By default they stay on your device. If you use Sync, that data may also be stored in your Google Drive so Sync can work. You do not grant Lernwerd a license to publish your notes or learning history.

You are responsible for the content of any notes you store and for backing up data that matters to you.

Lernwerd’s name, branding, layout, and original software elements of the Service are protected by applicable intellectual property laws. You may not copy or reuse them except as allowed by law or with our prior permission.

Dictionary and lexical content may incorporate or derive from third-party sources under their respective licenses, including Wiktionary / Wiktextract (CC BY-SA), Princeton WordNet (WordNet License), Tatoeba (CC BY), and COCA / wordfrequency.info–derived frequency bands. Your use of that content must respect those licenses where they apply.

The Service is provided for educational and informational purposes. Definitions, examples, frequency bands, and other lexical information may be incomplete, outdated, or incorrect.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LERNWERD AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (WHICH IS CURRENTLY ZERO FOR THE FREE SERVICE) OR (B) ONE HUNDRED US DOLLARS (US $100) OR THE EQUIVALENT IN LOCAL CURRENCY.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.

We may change, suspend, or discontinue features of the Service at any time, with or without notice. We are not obligated to provide any particular feature indefinitely.

You may stop using the Service at any time. We may restrict or terminate access if you violate these Terms or if we need to protect the Service or other users.

Provisions that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will survive termination.

These Terms are governed by generally applicable principles of law, without selecting a specific national jurisdiction in these Terms.

If a dispute arises, you agree to first contact us at the email below so we can try to resolve it informally. If informal resolution is not possible, disputes will be resolved in a forum and under procedures permitted by applicable law.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Service after changes means you accept the updated Terms.
